2.1 Age Requirement

You must be at least 18 years of age to create a MumTales account. By registering, you represent and warrant that you are 18 or older. If you are between 13 and 17, you may only use the Service under the direct supervision of a parent or legal guardian who has accepted these Terms on your behalf. The Service is not intended for use by persons under 13.

2.2 Account Creation

To access the Service you must create an account by providing a valid email address and a password. You agree to provide accurate, current, and complete information and to keep your account details up to date. False or misleading registration information may result in immediate account suspension.

2.3 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorised access to your account. We are not liable for any loss or damage arising from your failure to keep your credentials secure.

2.4 One Account Per Person

Each person may maintain only one active account. Creating multiple accounts to circumvent credit limits, bans, or other restrictions is a violation of these Terms and may result in termination of all associated accounts.

2.5 Account Transfer

Your account is personal to you and may not be transferred, sold, or shared with any other person without our prior written consent.

3.1 The Credits System

MumTales operates on a prepaid credit system. Each story generation consumes a specific number of credits (currently 1 credit per story, subject to change with notice). New accounts may receive a limited number of complimentary credits at registration.

3.2 Purchasing Credits

Additional credits may be purchased through credit packs available in the "Buy Credits" section of the Service. All prices are displayed in Indian Rupees (INR) or the currency applicable to your region, inclusive of applicable taxes where required by law.

3.3 Payment Processing

All payments are processed by Razorpay, a third-party payment gateway. By making a purchase, you agree to Razorpay's Terms of Service and Privacy Policy in addition to these Terms. We do not store your payment card details on our servers.

3.4 Billing

You authorise us to charge the applicable amount to your chosen payment method at the time of purchase. Purchases are final and non-refundable except as described in Section 3.5 below.

3.5 Refund Policy

- **Unused credits:** Credits that have not been consumed may be eligible for a refund within 7 days of purchase if you have not generated any stories with them. Contact [email protected] with your transaction ID to request a refund. - **Technical failures:** If a story generation fails due to a confirmed server error or AI service outage on our end, and credits were deducted, we will restore those credits to your account within 48 hours. - **Consumed credits:** Credits that have been used to generate story content (even if you are dissatisfied with the result) are non-refundable. - **Fraud or unauthorised use:** If credits were purchased through fraudulent means or in violation of these Terms, no refund will be issued.

3.6 Credit Expiry

Credits do not expire as long as your account remains active. Credits are forfeited if your account is terminated due to a violation of these Terms.

3.7 Price Changes

We reserve the right to change the price of credit packs at any time. Any price change will not affect credits already purchased. We will provide at least 14 days' notice of price changes via email.

3.8 Taxes

You are responsible for any applicable taxes, duties, or charges that apply to your purchase in your jurisdiction. Where required by law, we will collect and remit applicable taxes.

4.1 How Stories Are Generated

MumTales uses Google's Gemini large language model API to generate story text based on the parameters you provide, including (but not limited to) child names, ages, themes, characters, moral lessons, language preferences, and story length. The AI model generates the content in real time and the output is returned to you through our platform.

4.2 Nature of AI Output

AI-generated stories are creative works produced by an artificial intelligence system. They are not authored by a human and are not guaranteed to be: - Factually accurate - Free from unintended bias or stereotypes - Perfectly age-appropriate in all cases - Consistent in quality or tone across all generations - Free from repetition or unusual phrasing

4.3 Your Responsibility to Review Content

You are responsible for reviewing all AI-generated stories before sharing them with children. If you encounter content you believe is inappropriate, offensive, or harmful, you must not share it with a child and should report it to us immediately via [email protected].

4.4 No Guarantee of Specific Output

We do not guarantee that the generated story will match your exact expectations, preferences, or requirements. The inputs you provide are a guide to the AI model, not a strict specification. Credits are consumed upon story generation regardless of your satisfaction with the output.

4.5 Ownership of Generated Stories

Subject to Section 6 (Intellectual Property), you own the stories generated using your account and your inputs. You may use, print, share, and adapt the generated stories for personal, non-commercial use.

4.6 Prohibited Story Inputs

You must not input any content that is: - Sexually explicit or suggestive, including anything involving minors - Designed to generate content that glorifies violence, self-harm, or abuse - Targeted at producing hate speech, discriminatory content, or defamatory material - Intended to generate content that infringes on any third party's intellectual property - False or misleading information designed to deceive or harm

5.1 Image Generation

Where the Service includes AI-generated story illustrations, these images are created using AI image generation models based on the story content and parameters. Images are generated automatically as part of the story creation process.

5.2 Image Storage

Generated story images are stored securely in Amazon Web Services S3 buckets associated with your account. Images are private by default and are not publicly accessible except through your authenticated account session.

5.3 Image Content Safety

All image generation prompts are filtered and controlled to produce only child-appropriate, non-violent, non-sexual, and non-discriminatory imagery. Images are created in a cartoon, illustrated, or storybook style appropriate for children's content.

5.4 Ownership of Generated Images

Images generated through your use of the Service are owned by you for personal, non-commercial use. You may save, print, and share these images as part of the story for personal family use. You may not: - Claim the images were created by a human artist without disclosure - Sell or commercially license the images without our prior written consent - Use the images to train competing AI models - Submit the images to publications, contests, or platforms that prohibit AI-generated artwork without making the appropriate disclosure

5.5 Third-Party Image Model Rights

The underlying AI image generation models may be subject to their own licensing terms. We warrant that our use of these models is licensed for commercial service provision, but we cannot guarantee the absence of third-party claims on any specific generated image. We recommend against using generated images for commercial purposes without seeking independent legal advice.

5.6 Image Retention

Story images are retained as long as your account is active and the associated story has not been deleted. Deleting a story also deletes its associated images. We do not retain images after account deletion.

6.1 Permitted Uses

You may use MumTales to: - Create personalised stories for children in your care (family, classroom, childcare setting) - Print, download, or share generated stories for personal and educational use - Gift stories to others for personal, non-commercial use

6.2 Prohibited Uses

You must not use the Service to: - Generate stories with the intent to harm, bully, or embarrass a specific person - Create content that impersonates real individuals without their consent - Reproduce, resell, or sublicense generated content as part of a commercial product or service without our written consent - Use automated tools, bots, scripts, or scrapers to access the Service or generate stories in bulk - Attempt to reverse engineer, decompile, or extract the source code of any part of the Service - Probe, scan, or test the security vulnerabilities of the Service without written authorisation - Introduce malware, viruses, or any harmful code into the Service - Circumvent, disable, or interfere with security features, including rate limiting or credit checks - Use the Service in violation of any applicable law or regulation - Create an account or generate content on behalf of a minor without parental or guardian authority - Use the Service to generate propaganda, extremist content, or content that incites violence

6.3 Monitoring and Enforcement

We reserve the right (but not the obligation) to monitor use of the Service and to remove or block access to any content that violates these Terms. We may suspend or terminate your account for any violation without prior notice.

7.1 MumTales Platform

The MumTales name, logo, brand, website design, application code, user interface, and all other aspects of the platform (excluding user-generated content) are the exclusive intellectual property of Hauper Technologies and are protected by copyright, trademark, and other applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the platform without our express written permission.

7.2 Your Story Content

You retain ownership of the story inputs you provide (names, themes, etc.) and of the generated story output associated with your account. You grant MumTales a limited, non-exclusive, royalty-free licence to store, process, and display your story content for the purpose of providing the Service to you.

7.3 Feedback and Suggestions

If you provide us with suggestions, feedback, ideas, or improvements regarding the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use, incorporate, and exploit that Feedback in any way without obligation to you. We are not required to implement any Feedback.

7.4 Third-Party Intellectual Property

Some features of the Service incorporate third-party software, fonts, and libraries licensed under open-source or commercial licences. These remain the property of their respective owners.

7.5 Copyright Infringement

If you believe that content on our Service infringes your copyright, please contact us at [email protected] with: (a) a description of the copyrighted work; (b) the URL where the allegedly infringing content is located; (c) your contact information; (d) a statement of good faith belief; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.

8.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 AI Content Disclaimer

We do not warrant that AI-generated stories will be accurate, error-free, unbiased, or suitable for any specific purpose. AI models produce probabilistic output and we cannot guarantee the quality, appropriateness, or completeness of any individual generated story or image.

8.3 Service Availability

We do not warrant that the Service will be available without interruption, error-free, or free from viruses or other harmful components. Scheduled and unscheduled maintenance, third-party API outages (including Google Gemini), and other events may cause temporary unavailability.

8.4 Third-Party Services

We are not responsible for the availability, accuracy, or practices of third-party services integrated with MumTales (including Google Gemini, AWS, and Razorpay). Their use is governed by their own terms and policies.

9.1 Indirect Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HAUPER TECHNOLOGIES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.2 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) INR 500 (FIVE HUNDRED INDIAN RUPEES).

9.3 Essential Basis

THE LIMITATIONS OF LIABILITY IN THIS SECTION REFLECT A REASONABLE ALLOCATION OF RISK AND ARE AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN US. THE SERVICE WOULD NOT BE PROVIDED WITHOUT THESE LIMITATIONS.

9.4 Consumer Rights

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable consumer protection law. Consumers in jurisdictions with statutory consumer rights retain those rights.

11.1 Termination by You

You may close your account at any time by contacting [email protected]. Upon account closure, access to your stories will be immediately revoked. Unused credits are non-refundable unless you qualify under our refund policy (Section 3.5).

11.2 Termination by Us

We may suspend or permanently terminate your account, with or without notice, if: - You violate any provision of these Terms - Your account is associated with fraudulent, abusive, or illegal activity - We are required to do so by law or a court order - We decide to discontinue the Service

11.3 Effect of Termination

Upon termination of your account: (a) your right to access the Service immediately ceases; (b) we may delete your account data in accordance with our data retention policy; (c) any unused credits are forfeited; (d) provisions of these Terms that by their nature should survive termination (including Sections 7, 8, 9, 10, and 13) shall survive.

11.4 Service Discontinuation

We reserve the right to discontinue or substantially modify the Service at any time with reasonable notice (at least 30 days where practicable). In the event of service shutdown, we will make reasonable efforts to provide a credit refund for unused, recently purchased credits.

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. For users in the European Union or United Kingdom, mandatory consumer protection provisions of your local law apply in addition to Indian law.

12.2 Informal Resolution

Before initiating any formal legal proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. We will try to address your concern within 30 days of receiving your written notice.

12.3 Jurisdiction

Subject to applicable consumer protection laws, any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India. By using the Service, you consent to the personal jurisdiction of such courts.

12.4 Class Action Waiver

To the fullest extent permitted by applicable law, you and Hauper Technologies agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12.5 Time Limitation

Any claim arising from your use of the Service must be brought within one (1) year of the date the cause of action arose, or it will be permanently barred.

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hauper Technologies with respect to the Service and supersede all prior agreements, representations, and understandings.

14.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be replaced with a valid provision that most closely approximates the intent of the original.

14.3 Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative of Hauper Technologies.

14.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations at any time, including in connection with a merger, acquisition, or sale of assets, with notice to you.

14.5 Force Majeure

Neither party shall be liable for any failure or delay in performance due to causes beyond their reasonable control, including natural disasters, war, terrorism, government action, internet outages, third-party service failures, or pandemic.

14.6 No Partnership

Nothing in these Terms shall be construed to create a partnership, joint venture, agency, employment, or franchise relationship between you and Hauper Technologies.

14.7 Language

These Terms were written in English. In the event of any conflict between translated versions and the English version, the English version shall prevail.
